In this audio discussion, referring to some historical examples, I offer several observations arising from considering the intersection of the distinctions between customary and codified law, on the one hand, and Weber’s definitions of formal and substantive rationality, on the other. Hopefully the discussion also throws light upon some current events, particularly as they relate to the role of the managerial class in our legal systems. The audio sets the context for the discussion with an initial review of Harold Innis’ distinction between time and space biased societies. And, in the process, we find out why Canada is so “woke.”
